If this is the case, then any argument for due process, just compensation, or legal counsel is irrelevant. Perhaps management is culpable - they likely were aware that the paperwork wasn't legal... but don't complain about just cause and due process when you are knowingly gaming the system. Walk away, get another job at another restaurant that will turn a blind eye. I'm not saying go home (for many this *is* home), just accept that this is the cost of sneaking into a foreign country and defrauding your employer.
